Who We Are
We are passionate about what we do – which is to provide exceptional advice and representation to our clients. The firm’s two partners have 45 years of legal, financial, and accounting experience, which we draw upon in every client engagement. We have also worked at some of the largest defense firms in the country including Skadden Arps, Sidley & Austin, and Morrison & Foerster. After years of representing defendants, we switched the focus of our practice to representing plaintiffs. We know how defendants and their counsel approach a case, and are able to create a winning litigation plan at both trial and on appeal.
We bring a sophisticated and multi-faceted perspective to solve legal problems. Prior to attending law school, both of our principals worked as Certified Public Accountants and also possess extensive financial expertise. Howard has an MBA from the Wharton School of the University of Pennsylvania and spent several years working as an investment banker. Joel was a stockbroker for Merrill Lynch and subsequently worked in the finance department for the mortgage banking subsidiary of Metropolitan Life Insurance. Upon completion of law school, both of our principals had the honor of serving as law clerks for federal judges in California. Joel clerked for the Honorable Arthur Alarcon on the Ninth Circuit, and Howard clerked for District Court Judge James Ideman.
Our unusual backgrounds enable us to evaluate cases and formulate successful litigation and appellate strategies by considering the perspective of every stakeholder in a particular case. Because we formerly represented corporate litigants, we are well-versed with their playbook during all stages of the legal process and the various attacks that will be made against our clients. As a result of our clerkships, we understand how judges decide cases, and we also know how to properly prepare and present a case from filing through resolution of the appellate process. We do not file a lawsuit, motion, or brief without carefully considering the perspective of the court and the defense. Similarly, our preparation for oral argument, whether before the trial or appellate court, reflects our deep understanding of the adjudicative process and the defense strategy.
An added benefit derived from our backgrounds is that we often have added credibility from the standpoint of defense counsel, general counsel, and insurance carriers because we used to stand in their shoes and represent their respective interests. Consequently, we have had success settling very difficult cases both at the trial and appellate stages that might not otherwise have been resolved without additional legal proceedings.
Another compelling advantage we offer is the extraordinary legal talent available to work with TAR on high stakes matters both at the trial and appellate levels. These relationships provide a tremendous benefit to our clients and significantly increase the likelihood of a favorable outcome. In particular, we have established highly effective, collaborative working relationships with the following parties:
- Hagens Berman Sobol Shapiro, one of the preeminent national plaintiffs trial firms in the country that focuses on business litigation and consumer matters
- Erwin Chemerinsky, the noted appellate and constitutional scholar and Dean of the University of California, Irvine School of Law
- Robert Peck, President of the Center for Constitutional Litigation and one of the premier plaintiff’s appellate advocates and trial tacticians in the country
